Study On The Standardization Of Land Registration

Land is the most important material base that human beings rely on as well as the most fundamental material condition that helps society develop sustainably. Land registration is a process that land administration department on behalf of the government confirms land ownership, land use rights and other rights by legal means according to the laws and principles. Besides, land registration is not only the only means of administrating the land ownership and rights but also a basic work of land administration, the accuracy and legality of the land registration results is the "life" of the land registration. The standardization of land registration is the important content in construction of the land registration system and the key step for land registration standardization as well as the accuracy and efficient land registration result. As a result, this may help administrate land strictly, protect the legal rights and interests of land owners, accelerate the land market developing healthily and uphold the credibility of land registration.This paper makes a research on the existing problems in land registration standardization and the cause of the problems by discussing the development present situation of land registration. Moreover, we make suggestions for the improvement of land registration standardization and actual practice of land registration from five aspects including registration system, registration subject, registration technique, registration administration and research of latest problems.Firstly, the background and significance of topics as confessed, summarizes the research objectives, research contents and technical route, the relevant literature is briefly reviewed. In the second part of the paper, Based on the transaction cost theory, the change of real right theory and the effective government theory, catch land registration standardization requirements and standards, elaborated three kinds of theory and normative land registration between the relations, and as the theoretical basis of land registration. In the third part of the paper, from the land registration system, program, management, in-depth analysis of China’s land registration standardization status quo and existing problems. In the fourth part of the paper, analysis the cause of land registration standardization problem, summed up the reason mainly has the legal system is not perfect, the registration management is not standardized, the uneven quality of personnel, land registration land registration management means lag and so on several aspects. The fifth part of the paper is the countermeasure and suggestion. Recommendations from the registration system, registration body (person), registration technology, management, new situation and new problems of innovation five respects strengthen pair of land registration and management standardization construction.
