The Research About Building The Ordos City Enterprise Labor Dispute Diverse Mediation Mechanism

With the rapid economic and social development in Ordos City, thestructure of the labor market has undergone a lot of changes and labor relationsare becoming increasingly complex, labor dispute cases also showed a sharpupward trend. Although the country has successively promulgated the "LaborContract Law" and "Labor Dispute Mediation and Arbitration Law", but thedemand of society and the public for efficient labor dispute mediationmechanisms is growing increasing, labor dispute mediation capacity, to someextent, impacts to the Ordos City’s social harmony seriously.This paper first analyzes the connotation and characteristics of the labordispute mediation and other related theoretical knowledge; then we in-depthanalysis of the connotation, ideas, principles, philosophy, and the generalpattern in the diverse mediation mechanisms of labor dispute; after this, throughthe form of questionnaires, from the proportion of the staff who participate themediation work in mediation organization, the mediation cycle of general labordisputes, labor dispute body and it’s attitude of the general labor dispute,mediation plight, the frequency of cooperation mediation with other units, andthe number and type of Ordos City labor dispute cases in the past three years, weanalyzed the problems and the causes about the current labor dispute mediationmechanisms of Ordos City; Finally, against the specific circumstances of theOrdos City, as well as the idea of diverse mediation mechanism, we proposedthe ideas about diverse mediation mechanism of labor dispute from the buildingthe city administrative mediation center, transverse and longitudinal mediationsystem, the formation and institution building of mediation network relationship,personnel training and incentive institution, the structure of pre-control and post-control and feedback mechanism.
