The contribution of high-tech industry to the development of world economy is more and more prominent, and already become pillar industries in knowledge economy era. But from90s of20th century, overlapping patent overflow as floodwater in high-tech industry existing sequential innovation as semi-conductor, bio-tech, computers’software and communication, generated intensive patent thicket, which prevented new technology commercialization, restrained market competitions. A patent pool can pack the fragmental patents, provide direct solution to patent thicket problem. Nowadays, the industrial effects of patent pools is enhancing, becoming the domain paradigm of high-tech industry development, and attracted general attention of academics and business. Specially after DVD industry of China being collected expensive fee by pools as MPEG, DVD3C and DVD6C, government and enterprises already realized strengthen the construction of patent pools can greatly enhance the international competitive of our high-tech industry.Centering on one in "three fundamental issues" of patent pool research——"innovation effect", the paper studies the following research tasks. First, after reading a large number of documents, reviewing past scholars’ research about patent pool’s innovation, I find its empirical is so weak and almost all research centers on theoretical research. For this reason, the paper use dynamic economics and game theory to build the theoretical model, then do empirical research on three typical cases of MPEG-2, TD-SCDMA, IGRS patent pools using kinds of methods like analysis of different-in-different (abbr. DID) to verify theoretical results of patent pools’ innovation. Finally, combined with China’s patent pools’ status, the paper puts forward some countermeasures and suggestions to the development of our country’s patent pools, which support our country, formulate rational and effective policies for patent pools.
