Since the beginning of humans, soil has been providing resources necessary for survival food, shelter and other human. With constantly advancing human civilization, human use and transform the world continue to enhance the further development of industrial civilization, human destruction of the soil is also increasingly apparent. Currently, soil pollution has become one of the obstacles threat to human survival and development, threatening the interests of humanity and the modern descendants of generations. With the popular concept of sustainable development, more and more countries are starting to focus on soil protection, through a variety of ways to reduce or minimize damage to the soil. At present, the developed countries, including the United States, France, Japan, Germany, has established a relatively complete system of soil pollution prevention and control system, but also the feasibility of establishing an institutional framework and soil pollution prevention laws operability of bothIn contrast, although China has gradually emphasis the importance of soil pollution prevention and gradually strengthen legislation on soil pollution prevention and control, but for various reasons, the process of soil pollution prevention and control work is still relatively slow, did not reach a significant preventive effect. Must address the problem of soil pollution prevention aspects of the brunt of the inevitable is that there are many deficiencies in the establishment of a sound legal system and soil pollution prevention -related aspects. Lack of legislation will inevitably lead to the practice of no legal basis for the prevention and control of soil pollution makes it difficult to run efficiently, can effectively reduce or prevent further deterioration of soil pollution soil pollution levelsIn this paper, in order to build soil pollution control system as the core content, through a lot of reading and collecting soil pollution -related information on the characteristics of soil pollution, soil pollution classification, soil pollution and other hazards elaborate, soil pollution prevention and control system for the proposed construction of the proposed to provide theoretical and empirical basis through the exploration of the status of soil pollution, soil status quo of China’s pollution control system analysis, clear shortcomings of the current lack of soil pollution prevention and the legal system in our country, for the soil contamination related to the establishment of a sound system to provide provided support; through research abroad (Japan, Germany, France, the United States, South Korea and other countries) on soil pollution prevention and other aspects of the legislative model, the legal system, relevant experience and practice system constructed to extract the appropriate reference and adoption of our experience and practices, combined with China’s actual conditions, soil pollution prevention and control for the system set up to provide recommendations put forward looking and workable practical experience; by discussing legislative mode, legislative concepts, such as the basic system, and ultimately make appropriate country soil pollution prevention and control legal system, put forward constructive suggestions for soil pollution prevention system running smoothly in China, hoping to have their own science, soil pollution prevention and remediation of system building blocks.
