On The System Of China's Environmental Standards

The emergence of environmental standards are from the increasingly serious environmental problems prevailing in different countries around the world, China has experienced rapid economic development in a period of nearly three decades since the last century, during which significant changes in the socio-economic, at the same time, the environment is also undergoing significant and profound changes. It is in this reality, environmental standards system has been an important role as a protection for life and property safety of citizens, maintain social and material wealth, balance of ecological environment and other important features of the legal system. With the rule of law, put forward the concept of nation-building, but there are some disadvantages of the system in the legislative framework, management mechanism, or a higher level of legislative concepts of the current building sustainable development in a socialist country. This article is the analysis of the formation of China's system of environmental standards on the basis of the reasons, integrated world's more developed countries' relevant legal system, further analysis of its architecture, the current status of legislation and practice, find out the response of this system in our country.In this paper, through the horizontal comparative study of different countries and regions of environmental law, the discovery will help improve China's environmental laws and improve the theoretical results of the successful experiences; also have philosophical analysis of hair approach to explore the deep-seated reasons,which produces environmental standards in China and in the world system, and from historical, economic system changes in the international political factors, changes in such areas of practice to reflect the long history of mankind in the process of the formation of anthropocentric ideas.This paper is divided into four parts:The first part describes the basic concepts of environmental standards and characteristics of the system, clear China's environmental standards'position in the whole system of the environmental laws; In addition, the system elaborated on China's environmental system of standards development and implementation of the basic information, as well as the system architecture. The text set out with a more detailed relationship between environmental standards and sustainable development, pollution prevention, the conservation of natural resources, highlighting its important role in the areas. This part of the discussion from the macro-level of environmental standards was introduced to form a basic understanding, also gave a further in-depth exploration for the below.The second part gave a more detailed introduction of the European Union, the United States, Japan and Sweden' environmental standards firstly, focusing on the successful experiences of the maturity of the system from developed countries to support China in terms of improving related systems.The third part discusses the formation of China's environmental standards for a variety of factors, including historical factors, namely, changes in the mode of production relations and the environmental standards of environmental protection system, impact of changes in the economic system from the original agricultural production to the extensive large changes in industrial production system, as well as the impact of political factors and environmental awareness; Second, the focus of analysis of China's current system of environmental standards, legislation, law enforcement, and management of all aspects of the problems, including backwardness of legislative thought, incompletation of the standard system, and world-wide environmental standards do not match as well as in the management system. By analyzing the reasons to find ways to improve China' environmental standards.The fourth part is the focus of this paper that proposed solutions against the issues raised previously. The problems are resolved the questions of environmental standards in our country through five parts, namely, changes the ideological position of standard-setting stage of legislative, through more advanced guiding ideology for the formulation and implementation of environmental standards; increases the natural resources and environmental protection standards, enrich our country's environmental standards; through the integration with the international environmental standards, and gradually improve the current "green barriers" and other trade problems for production of China's manufacturing enterprises; updates and improves timely the management process of the environmental standards to meet the fast-paced economic development and environmental protection requirements; improves the related system of environmental standards, make China's environmental protection work more solid and effective.
