At present, that the concentration of greenhouse gases such as carbon dioxide inthe air gradually increases lead to global climate change. With the global climatechange constantly bring great disaster to mankind, global climate change problem alsogradually bring the attention of the world and the concern of scholars. Takingeffective measures to reduce the greenhouse gases such as carbon dioxide in theatmosphere become one of the most important task. To this end, the internationalcommunity has carried out a series of international environmental conference. Theinternational community analyzes and discusses the influence of the global climatechange on human and how to deal with global climate change. In internationalenvironmental climate change conference formulated the United Nations frameworkconvention on climate change. It points out that global climate change is mainlycaused by human activities, and the convention puts forward the concept of forestcarbon sinks for the first time. Congress thought forest as the biggest land ecosystem,the most greenhouse gases in the atmosphere can be absorbed by the forest. Followedby the United Nations climate conference passed the Kyoto protocol, the protocol inresponse to global climate change process has a very important role. The protocol isthe first force law about global climate change. The protocol also puts forward theclean development mechanism, the developed countries provide funds and advancedtechnology to developing countries, and thus the reduction of greenhouse gases canbe used to offset the mandatory emission reduction obligations of developed countries.Clean development mechanism gradually bring forest carbon sinks trade market.Forest carbon sinks trade system as a new forest ecological compensation mechanismto reduce the greenhouse gases in the atmosphere, it not only inhibits the globalclimate change, and also provides capital for developing countries and advancedtechnology,to promote the development of developing countries. Clean developmentmechanism (CDM) as a win-win mechanism and gradually get general recognition ofthe international community.Since the reform and open policy, our country has experienced rapid economic development. But behind the high economic growth,we see uncontrolled industrialproduction and large amounts of carbon dioxide. At present, our country has becomethe largest country in the carbon emissions, carbon dioxide emissions is more thanthe United. Although in the first commitment period,China as a developing countrydoes not assume the obligation of mandatory emissions of greenhouse gases. but withthe arrival of the second commitment period, developed countries will ask developingcountries such as China to assume a mandatory emission reduction obligations. At thesame time, China as head of the country actively makes a commitment to theinternational commitments, promises to2020, the national unit of gross domesticproduct (GDP) of carbon dioxide emissions40%lower than in2005. Our countryshould keep up with the pace of international limits reduction and take concrete andeffective measures to fulfill their commitments.Based on the above background, this paper mainly discusses the forest carbonsinks on concrete analysis and research. The first part is the basic theory of forestcarbon sinks. This part analyzes the cause of global climate change, impact, andproposes the significance of forest carbon as to reduce the effect of greenhouse gasesin the atmosphere. The second part mainly studies the forest carbon sinksinternational legal rules, analyzes the international conference on the evolution of thelegal system of forest carbon sequestration, and the inspiration of our country. Thethird part mainly elaborated the basic current situation of forest carbon sequestrationin both at home and abroad and the forest carbon sinks trade system running in China,and points out that the development of our country legal system of forest carbon sinksand its basic problems. The fourth part expounds the construction of legal system ofthe forest carbon sinks. It should be mainly include the forest carbon sinks propertyrights law system, the forest carbon sinks ecological compensation legal system andlegal system of forest carbon sinks trade.
