Research On Our Country’S Legal System Of Prevent And Control Cultivated Land’S Pollution

Cultivated land is basic resource for human,the lifeblood of grain production,the foundation and guarantee of human survival. In 2008 October announced "master plan of national land use(2006-2020)" clearly provides the amount of cultivated land, emphasizes the protection of cultivated land. But the amount of cultivated land should not only protect the quantity of cultivated land, also should protect the quality of cultivated land, quantity have not quality is worrying. Provisions of our countray’s existing laws on the protection of cultivated land is amount of protection of cultivated land,provisions for protect and improve the quality of cultivated land is less,of course there is no provisions for prevent and cure the polution of cultivated land. Legal system of prevent and cure the polution of cultivated land is necessary for the protection of cultivated land’s quality, can ensure the safety of food and promote the sustainable development of agriculture,is a better method to solve the problem of agriculture, and is an important way to promote chinese export of agricultural products. The state promulgated "Law of prevent and cure Atmospheric Pollution " and other special law of prevent and cure environment pollution, but there is no specific legislation on the prevent and cure of pollution of cultivated land. In order to solve the serious pollution problems in our country is necessary to make “Law of prevent and cure polution of land and improve the existing legal system.Therefore,this article carries on the discussion on law of prevention and cure the cultivated land’s pollution,this paper aims to improve the attention of management departments and public on the cultivated land’s pollution, strengthen the comprehensive improvement of land pollution, improve the legal system of prevention and cure of land’s pollutionThe main content of this article is to overview the meaning of cultivated land and cultivated land’s pollution,pollution’s status,causes,consequences,and significance of prevent cultivated land. Then briefly list our country’s laws and regulations about provisions of prevent and control the cultivated land’s pollution,and analyse and summariz the deficiency and content of the legal system, and then discuss the legal system of prevent and control cultivated land’s pollution in foreign countries. Finally, through analyse and reference the imperfection of our country’s legal system and foreign experience.
