Being as one of the most basic element of the environment, soil was not protected well, the pollution of the soil is so serious that it has posed threat to the survival and development of human beings. In China, soil pollution has been very serious. “The event of Poisonous Rice”, “the event of heavy metal vegetables” etc, are frequently reported, which has constantly sounding the alarm for us. One of the most important reasons of soil pollution is the deficiency of the legislation, so it’s necessary to introduce a law to prevent and control the pollution of the soil. Much beneficial discuss about the legislation of the prevention and control of the soil pollution has been made by many scholars, based on the former discuss, the article will make comprehensive analysis, in order to provide some beneficial suggestion to the legislation of the prevention and control of the soil.The theme of the article is the legislation of prevention and control of soil pollution, and the article is divided into four parts.The first part is an overview of soil pollution. It’s divided into two sections: the first section analyzed the definition and characters of soil pollution; the second section analyzed the causes and influences of soil pollution, in order to deepen the understanding of soil pollution. The purpose of this section is to establish a basic understanding of soil pollution, providing the basis for further analysis.The second part is the necessity of legislation for soil pollution prevention. It’s divided into two sections: section one analyzed the current situation of our nation’s soil pollution, which described the “symptom of the disease”; section two analyzed the current domestic legislative situation and reflection, figured out the shortcomings by systematic analysis of the existing legal documents, pointed out the “cause of the disease”. The analysis of the “symptom of the disease” and “cause of the disease” provides necessary basic for legislation on soil pollution.The third part is research on overseas legislation of prevention and control of soil pollution. It’s divided into two parts: part one analyzed the legislation of soil prevention and control of America, Japan and Germany, making selective analysis of each nation’s principle regulations of law. Section two revealed enlightenment to us by these laws. Through taking example of these laws, it provides experience for us to enact our law of prevention and control of soil pollution.The fourth part is the establishment of legislation of prevention and control of soil pollution. It’s divided into three sections: section one analyzed the principles of the legislation; section two analyzed the regulations of the legislation; section three analyzed the liability of soil pollution, the three sections established the framework and nuts and bolts of the legislation.
