Soil is the most precious natural resource. Human beings obtain the survival of all the material from the soil. The quality of the soil directly determines the quality of human life. However, with the rapid change of science and technology, and the industry scale continuous expansion.A large amount of pollutants were produced. These pollutants cause the soil quality to deteriorate day by day and affect the basic life of mankind. Developed countries have already carried out special legislation on soil pollution. But China has so far no specific laws of soil pollution prevention and control. The formal implementation of the government regulations of the 《Fujian province soil pollution prevention and control measures》 in February 1,2016. Followed by local regulations in February 2nd 《Hubei province soil pollution prevention and control regulations》 through the review and formally implemented in October 1,2016. Therefore this text through research to promote China as soon as possible to consider the national soil pollution prevention and control law. In order to change the rules of soil pollution prevention and control in China’s state out of order and establish and perfect the legal system of soil pollution control.In the first part of this paper, the concept of soil pollution is analyzed and clear the concept of soil pollution.A detailed analysis of the present situation of soil pollution and show the critical situation of soil pollution in China. The second part analyses the present situation of the legislation of soil pollution in our country. Respectively from the 《constitution》, 《environmental law》, as well as the introduction of local laws and regulations— 《Hubei Provincesoil pollution prevention and control regulations》 were analyzed. And realize the laws of the prevention and control of soil pollution is too scattered and localized. On the prevention and control of soil pollution in the country is extremely unfavorable. And through the analysis of typical cases to illustrate the special legal protection in urgent need of soil resources in China. The third part analyzes the legislative experience of the developed countries. The legislation of Japan and Germany were analyzed respectively. From which we can see that the developed countries’ legislation is more systematic and perfect. The fourth part through the analysis of the previous text, several suggestions are put forward for the prevention and control of soil pollution in China in order to establish and perfect the legal system of soil pollution prevention and control in China.
