Agritourism is a sunrise industry which is in the ascendant. With the rapid expansion of economy and urbanization, urban environment is deteriorating, and all sorts of "modern civilization diseases" tend to appear. Many people have been deeply troubled. Returning to nature to release the physical and psychological pressure becomes the inner demands. With the fresh scenery, colorful farming-culture and plain local custom, agritourism not only satisfy people’s needs, but as an important mean to adjust agriculture structure, promote farmers’ income and develop rural economy. Accompanying with Chinese governments at all levels attach great attention to, agritourism is developing rapidly. But there are a series of problems arising, such as resource damage, ecological pollution and other pollutions. It is badly in need of environmental theory guidance and legal supervision. Nowadays, agritourism legislation arouse lot of people’s attention, but the research of this field remains blank. So study on this field not only has theoretical significance, but has more practical value.This study according to the Theories of Sustainable Development and Environmental Law to discuss the issue of establishing the environmental regulations of agritourism development. With the method of documentation, this study uses a combination of Tourism Science, Ecology, Environmental Law to discuss the problem of lack of environmental regulations. Combined with the detailed analysis of material and the practice of agritourism development, this study suggests that there are many problems on agritourism environment, such as project development, agricultural production, resource utilization, environment construction, etc. There are many features of environmental damage: the damage hidden for a long time, the damage range is wide and lasting long, and its recovery is difficult. While the existing environmental law system can’t play effective role in many aspects of agritourism environmental protection. With the case study, it was found that establishing the environmental regulations of agritourism is closely related to its industrial development and prosperity. Comparative study shows that the United States, Germany, Japan, Taiwan and other countries and regions which make a great success on agritourism development in the world attaching great importance to establish the environmental regulations of agritourism. Legal leverage is not only useful for protecting ecological resources, but also play a positive role in coordinating the relationship between the economic benefits and environmental benefits. So we believe that it is important to establish the environmental regulations of agritourism development.Thus this study proposes some suggestions hoping that are benefit for its establishing. For example, to unify environmental management of agritourism, strengthen environmental law enforcement, improve supervision mechanism of environmental law, make more complete environmental regulations, which contains industry-access system, payment system, and set up non-governmental organization of rural environmental protection, etc.
