As the material basis for mankind to survive, soil is one of the country's most important natural resources and the major component of ecological environment. The environment state of soil directly affects the development of the national economy and the environmental security of the land resources, and is related to the safety of agricultural products and human health directly as well. To strengthen the environmental protection of soil and prevent soil pollution are the important tasks in China to achieve sustainable developmental strategies and to ensure green food for her people. This paper aims at improving China's legal system and the legislation on soil pollution prevention.This study is under the background of the sustainable development of the national economic society. It combines the theories of law, environmental resources law, resources ecological economics, natural resources science, ecological science, and other related theories. Empirical analysis, value analysis, comparative analysis, economic analysis and interpretation of legal principles were applied in the research. In the first part, the theoretical basis of China's Law on Soil Pollution Control was demonstrated and established, with the main focus on the eco-systematic resources and features of soil pollution and from the Ecological and Environmental Resources Law. Based on the current situation of the soil pollution and its legislation, it is claimed that the improvement of the legislation of China's law on soil pollution is pressing. In this part, the unique characteristics of soil pollution has been taken full account so that the legal system for soil pollution control distinguishes from other legal systems for pollution control. In the second part, standard systems for soil environment, cleaner agricultural production systems and soil rectification system were discussed selectively in view of the dual goals of soil pollution prevention and rectification in the fields of basic standards, pollution prevention and control. Three historical legal systems of various kinds of laws and regulations and state policies were retrieved and sort out. Their shortcomings were analyzed, and suggestions were raised on how to improve China's legal system on soil pollution prevention and control with the reference of foreign experiences in soil pollution prevention and control.
