Legal Research On Protection And Exploitation Of Water Resources Of The Yellow River

Water is the root of our life. Water resource is not only the fundamental nature resources but also the strategic economic resources. Nowadays, more and more people focus on the water resources crisis. China as well as the whole world is short of water resources. Confronted the fact that China is developing very fast while the water resources shortage is becoming more and more serious.it is of great importance to carry out a research on legal protection of the water resources. In this way, we can establish a perfect legal protection system on water resources and bring it into full play. So the limited water resources can not only meet the needs of the current generation but also the next generation.Yellow River, the second-longest river of China, which is called the "Mother River of China" had bred the thousands years of splendid culture of Chinese nation. As an important river which concerns the development of economy and society, it is the most complex river all over the world. With the economic development of this area, more and more waste water were poured into the Yellow River. Meanwhile, with the rainless period becoming longer and water interception becoming more often, the quality of the water is very low now. The shortage of water resources of the Yellow River may lead to the situation of no water to use no matter it is rainless or not. The supply and demand contradiction is getting more and more serious. The deterioration of the ecological environment of the Yellow River forced us to strengthen the protection and exploiting work of it. The severe fact of the water resources of the Yellow River has exposed many shortcomings and defects in the protection work.This paper conduct a research on the protection and exploitation of the water resources of the Yellow River from the legal aspect. This paper was divided into five parts:Chapter one is introduction. This part mainly expounded the research background, objective and meaning. It also discussed some research method of water resources of other rivers both at home and abroad. Chapter two is about the protection and exploiting of water resources of the Yellow River. It mainly introduced the specific characters of it and the current situation and the necessity of the exploitation. Chapter three is about the general legal situation of the protection and exploitation of rivers abroad. It can be divided into two parts. The first part mainly introduced some legal practices in Australia, Germany, Mexico and so on, and analyzed the legal characteristics of those countries. The second part mainly introduced the revelation of protection and exploiting of water resources abroad for that of the Yellow River. Chapter four is about the existed legal problems and reasons of the protection and exploiting of the water resources of Yellow River. It analyzed some issues on the legislation, construction of administrative law enforcement, ecological compensation of water resources, water rights system and public participation system in the protection and exploiting of the Yellow River from the legal aspect. It also analyzed the reasons that caused the above problems. Chapter five is about the legal solutions to the problems of protection and exploiting of the water resources of Yellow River. In order to solve the current problems, the author put forward some legal suggestions:construct the "regulation of water resources protection of the Yellow River" to provide the legal ground for the administration. Enlarge the law-enforcing ranks of the Yellow River. Set up and amplify the ecological compensation system and water rights system of water resources of the Yellow River. Make sure the water resources were allocated rationally and make an integrated planning of exploiting water resource according to the law. At the same time, strengthen the function of public participation system in the protection and exploiting of water resources of the Yellow River.
