A Study On Flag State Performance Evaluation Based On PSC Inspection

Since the 1980s, marine accidents occurred frequently and endangered the safety of life and the marine environment seriously. International Maritime Organization and port authorities have paid high attention to marine safety. International Maritime Organization has proposed to implement the triple responsibility:International Maritime Organization develops the conventions, flag state implements the conventions, and port state supervises and inspects the implementation of the conventions. The purpose is to eliminate sub-standard ships from the shipping market. Port state control has been recognized an effective mean by the international community to eliminate sub-standard shipping, to protect the safety of life at sea and the marine environment.At present, most of the memorandums of understanding on port state control organizations have established flag state performance evaluation system to supervise flag state the implementation of international conventions. Paris MOU and Tokyo MOU adopted the flag state "black - gray - white "list system, which divided flag state performance into" black - gray - white "list according to the flag state fleet detention rate in the recent three years.This article describes the concepts of flag state responsibilities, flag state implementation, flag state performance related concepts and port state control, as well as the port state control regime status of major regional memorandum organization and countries. This article also analyzes the shortcoming of the flag state "black - gray -white "list system:lack of inspection data from other port state control regions, applies only to the flag state inspection with a large sample of data, lack of negative factor of maritime accidents. In view of the above shortcoming, this article proposes a method to improve the flag state performance evaluation system. First, coordinate and harmonize regional memorandum organizations, integrate the port state control inspection data of all regional memorandum organization and evaluation the performance of flag state performance. Second, adopt a method based on Bayesian average to improve the existing flag state "Black - gray - white" list system and solve the shortcoming of the existing evaluation methods only application to a large sample of inspection data. Third, propose to increase the negative impact of maritime accident in the flag state performance evaluation method. Finally, this article gives some proposals to enhance the flag state performance.
