| The sixth census of China in 2010 indicates Chinese migrant labor has reached an unprecedented peak of 260 millions. Immigrant labor has made great contributions to China’s urbanization, so their health is not only a personal issue, but also a social problem. From this perspective, this paper analyzes the health of immigrant labor, based on data of China Labor-force Dynamics Survey hosted by Sun Yat-sen University in 2012, so as to learn characteristics of their health status and focuses on the health effects of their labor rights and interests.This paper compares the labor rights differences and health differences between immigrant labor and local workers and systematically analyzes the impact on the health of the labor rights and interests through quantitative research method and comparative analysis method. This paper brings to a conclusion: First, immigrant labor is healthier than local workers physically, but their mental health is worse. Health Migration Theory cannot perfectly explain China Immigrant labor. Second, for both immigrant labor and local workers the social security and labor abuse situation is not optimistic, and it is worse for the immigrant labor. In China, Marx’s alienation theory has a strong explanatory power on the immigrant labor. Third, Labor Security Factor on health including physical health as well as mental health is not obvious, but Labor Damage Factor strongly harms both physical health and mental health. Infringement of the labor rights and interests, to a certain extent, affects the health of Immigrant labor is more intensive than local workers. On the one hand, China labor laws and regulations are relatively comprehensive, and provide a legal basis for the protection of Labor rights and interests of immigrant labor. On the other hand, some defects of labor laws and regulations make it difficult to safeguard the rights and interests of immigrant labor. Moreover, the executive of the laws and regulations of labor rights and interests is poor in some places, which greatly weakens the practical effect of the legal provisions, exacerbates the health risks of immigrant labor. |
