The Research On Property System Of Chinese Buddhist Temple

With development of economy, buddhist temples are more and more involved into seculareconomic activities. Their property legal system concerns not only existence and development oftemples, but also improvement of Chinese religious legal system. Paper analyzed templeproperty system and put forward suggestions on how to improve it. Paper reviewed sources andconstitution of temple property system, summarized and analyzed present situation of its legalprovisions and introduced its problems, including no law to give a clear definition of its holdersof rights, indeterminate property rights and loopholes in using and managing property. Byresearch, paper found the reason why there are problems is that temple property system isinfluenced negatively by traditional view, traditional property system of buddhist temple, policyoriented and legal assistant temple property protection system and the property-purpose doctrine.By analyzing problems and reasons of temple property system, considering our nationalconditions, paper presented concrete proposals for improvement, that is to establish temple’smain position of rights by passing laws, to confirm subject of right of ownership and to improvesupervision system.
