The Exploration On Robber Cases Of Now-called Hubei And Hunan Province During Wanli Period In Ming Dynasty

In Grade Two,I participated in a reading party about court documents of Ming and Qing dynasty. We neatened the legal provision from Tang dynasty to the late Qing dynasty, and study with the court documents from the same dynasty. Through the discussion of per month, we benefited a lot. At the same time, I opened up new horizons and found the Major Research Direction.As the current Ming and Qing dynasty’s court documents research, it focus on the court documents which have proofread already. For example, Mengshuizhai court documents,Zheyu court documents,Xugong court documents and The court documents From Old times which are proofread by Prof.Yang yifang. The research about the court documents which existed in scholar essays of Ming dynasty have not been concerned. Meanwhile, the studies of Hubei and Hunan Province always centralize in revolutionary cultural studies from 1911.On the one hand, the studies of Hubei and Hunan Province start from culture communication and social construction. On the other hand, the emphasis of local legal history is Foreign settlement or minority. Therefore,the studies of Hubei and Hunan Province about judicial judgment are valuable. What is a coincidence. I found a rare court documents named Huxiang court documents which written by Qian Chun, who is a official of Ming dynasty. In these files, he collected the cases which he heard before. These cases are about murder and robber which occurred in Wanli period. Compared with other court documents of the same time, we can find the robber cases are more than other area in Wanli period. Except Qian Chun’s essays, the Masashi and chorography also record the phenomenon of robber. Why the robber arose in Hubei and Hunan Province so often? It becomes my the purposes of this article.In my essay, there are five parts. Introduction and four chapters.The introduction includes the significance, the academic history and the text of research.The first chapter describes the general social situation of Hubei and Hunan Province for that time. The phenomenon of that society can be showed in Masashi,chorography and scholar essays of Ming dynasty. The robber cause can be analyzed in geography, disaster,social situation and humanistic quality.The second part includes the robber cases of Huxiang court documents. The type of robber can be divided in three forms, and the robber cases can be also classified in four types. Then,I analyzed and evaluated the strategy which the government presented for that time in order to highlight the characteristics of Hubei and Hunan Province.The third part discussed the articles of robber crime and the practice of the official. The judicial practice of robber cases include about reporting, collecting evidence,applying the law,judging and the abuse of the local official.The last part appraise the robber cases of Hubei and Hunan Province. Compared with Guangdong Province, we can find the characteristic of Hubei and Hunan Province.From the little robber case, we can see that social stratum divisive, legal system flawed and official’s self-seeking misconduct.
