On The Judicial System Reform Of The County Grade In Hubei Province In Years From 1927 To 1937

On the foundation of the historical data, such as files, newspapers and magazines etc., using the theories of the History of Law and Sociology, the method of comparison research and analyzing the history, the paper try hard to discuss and evaluate the Judicial System Reform of the County Grade in Hubei province in the years from 1927 to 1937 form the angle of Judicial Independence.Chapter 1 discuss the introduction of the Judicial Independent Principle and initial formation of Supervisory Judicial System. Though the Judicial Independent Principle was superficially established, Judicial Independence was really nominal because of various obstacles. Supervisory Judicial System, which restricted Judicial Independence from midst and last , presented many faults from the beginning of its formation.Chapter 2 profoundly probes into the Judicial System Reform of County Grade in Hubei province during that period. This chapter contains three parts: the first is the progress of the reform in which the three kinds of Judicial Organization forms of Judicial Committee Bureau (Judicial Bureau in short), Judicial System supervised by county government and Judicial Department exist successively during this period. The second discuss the situation of Judicial Organ which relate to four aspects: arrangement of the judicial personnel and their right and responsibility, judicial outlay, inquisition of law cases, appointment and appraisal of judicial personnel. The third is about the characteristics of reform: containing traditional and modern judicial essence, exploitation with the innovation, the big step and the strong strength.Chapter 3 is to analyze and remark on Judicial System Reform of County Grade in Hubei province in the years from 1927 to 1937.Try to give the appropriate remark on the Judicial Bureau, Judicial System supervised by county government and Judicial Department established in different period from the angle of Judicial Independence.
