An Empirical Study On Safeguardingof The Intangible Cultural Heritage About Suzhou Embroidery In Zhenhu Street

Safeguarding of the Intangible Cultural Heritage plays an important role in the preservation of cultural diversity and stimulating human creativity. The Intangible Cultural Heritagearedisappearing fast, so safeguarding the Intangible Cultural Heritage has become the urgent problem in front of the international community.This paper is based on the basic theory about safeguarding of the Intangible Cultural Heritage, combined the reality in Zhenhu Street. It studies "the safeguarding of the Intangible Cultural Heritage aboutSuzhou embroidery in Zhenhu Street". Firstly, this paper clarifies the word "safeguarding" about the Intangible Cultural Heritage including three meanings. The three meanings are saving, protection and development. Secondly, this paper introduces four main means of safeguarding the Intangible Cultural Heritage, together with the present situation to put forward the perfect system of safeguarding the Suzhou embroidery inZhenhu Street. It is important to note that this article puts forward the productive protection of safeguarding, except the combination of civil rights protection and administrative protection. In view of the frequent lawsuits about intellectual property, establishing relevant benefit sharing mechanism is proposed. Finally, it mainly analyzes the safeguarding of the Intangible Cultural Heritage about Suzhou embroidery in Zhenhu Street within the framework of intellectual property. For innovative products of intellectual property protection, "first" creation should be paid to the copyright protection; "second" creation, combined the reproducibility, copying the content of the terms of creative works and expression forms of repeatability comprehensive to judge, it is regarded as a kind of special skill intellectual achievements or as "statutory license" category. By expanding the article 22, 23 related explanation about statutory license and fair use in <copyright law>, it finds relevant basis for use of embroidery in the particular case. To outside its scope, it also look forward to clarifying in the future laws.This paper puts forward to providing new ideas for the development of Suzhou embroidery in Zhenhu Street, to make the intangible cultural heritage protection in our country be largely improved.
