A Research On Nozick’ S Rights Theory

Individuals have rights,and there are things no person or group may do to them(without violating their rights).In Anarchy, State and Utopia, Nozick begins with the attitude of a libertarian, directly expressing the key to his political philosophy--individual rights.Individual rights as the core, running through Nozick’s national theory and his whole political philosophy, is a moral constraint of Kant’s moral principles and absolute laws. It is not an ideal of purpose and measure. The establishment and management of the country does not aim at individual rights, expanding and strengthening the individual rights maximumly, or reducing the invasions on the individuals rights minimumly. It is a moral marginal constraint of negative meaning.In other words, individual rights is a kind of effective marginal constraint for any behavior.From the national level, any behavior which does harm to the individual rights, even it is for purpose of expanding the rights of the individuals, can not be used as an excuse for infringement.Individual rights are in the most fundamental status. According to the individual rights, Nozick extends to what he said the social structure of dominant protective association, the weakest nation and utopia, showing his freedom supremacist idea from the origin, function and value.Individual rights are in the most fundamental status. This article will study on Nozick’ s right theory from five aspects. First of all, the paper will elaborate the theoretical basis of Nozick’ s political philosophy. Secondly, the creation of nation and its necessity. Through the positive and negative aspects, I will analyze the national’sorigin, function and legality from Nozick’ s context to understand his rights theory.Thirdly, the rights context of justice. I will study Nozick’ s rights theory by contrasting Rawls’ s and Nozick’ s views of justice. The last but one, through the description of Nozick’ s utopian, the paper will find the ideal of his personal rights and value orientation. Last but not least, I will make comments on Nozick’ s rights theory and propose some fresh and feasible ideas for the government of China in reform.
