A Legal System Study On The Charity Organization Of China

Charitable organizations is an important carrier of modern philanthropy, it is also anideal platform for optimal allocation of charitable resources. The healthy development of thecharitable organizations is of great significance for promoting charity legislation and theprocess of democratization, improving the utilization efficiency of charitable resources,promoting the human spirit civilization and social harmony. So far, the Chinese charitableorganizations are not only lacking of specialized and systematic legislation, but also havemany legal defects in external supervision and internal management, which have seriouslyhampered the rapid and healthy development of Chinese charitable organizations.The article selected the legal system as the object and the body consists of three parts:The first part introduces an overview of the charitable organizations, it contains the legalconcept, legal characteristics, legal form, the value and function of the legislation, thehistorical evolution of the legal system in both West and East; The second part describes manylegal defects of charitable organizations in China, it refers to the lack of supervision andmanagement system externally and defects of operation and management system inthemselves; The third part describes how to prove the legal system in China, it containsformulating basic law of charitable organizations in China, improving the charitableorganizations regulatory regime externally and management system internally.
