Family planning, as a basic state policy, has been running for30years in China.Under the policy, laws and regulations referred to family planning, is also increasedand enriched. There is no doubt that both the policy and the administrative law make agreat contribution on economic development and social development. However, thefamily planning policy is opposite to the ideas of our traditional birth custom; inaddition, the subject of the administrative law lacks the concept of the rule of law;which making the family planning law enforcement exposed many problems in theprocess. It reflects the serious conflict between the public power and private right.Nowadays, the concept of the rule of law and the eager for right become more andmore important. Under the situation, new requirements and higher standard are putforward on the family planning administrative law.On the basis of comprehensive analysis of the problems, it is about to seek thesolutions on these contradictions. This article is divided into four parts. The first partsummarized the academic circles’ reviews on the family planning and family planningadministrative law enforcement. The second part analyzes the basic concepts, contentsand existing problems of the family planning administrative law. The third part isanalysis the cause of the problem in the perspective of rule of law. The fourth part ison the basis of former three parts, on what is to perfection the law.
