Study On The Standard Of Food Safety Law System In China

SanLu milk powder incident in2008, opened China’s food safety problems of the bigscreen, since then，food crisis has occurred one after another。For example，San YuanYubomilk induced precocious event； SanLu melamine milk powder incident； Shuanghuiclenbuterol event；Shanghai stained bread events；Nongfushangquan standard door event andso on。If we take a list, there are so much examples that we can’t count。The review of theseries of food safety incidents, from children’s milk to the drinking water, the whole societycan not guarantee any kind of food’s safe；From small hand workshops to state-ownedenterprises, the whole community can not guarantee that any manufacturing company will notproduce any food which exists some problem。The events of our food safety are getting moreand more serious. Food safety need to be guaranteed by the food safety systems，otherwise，food safety standards are the cornerstone of the food safety system。At present, China’s foodsafety standards are not "standard", which has been the soft underbelly of the domestic lawsof the technical, but also the source of many problems。In this paper, in order to help improve the legal system，we regard "the legal system offood safety standards" as the theme and have a shallow research on it。Ministry of Health andother eight departments jointly develop a "national food safety standards," Twelve Five "plan"will also improve the food safety system as the national standard for future priorities。Theplan states: according to the national food safety standards that should be scientific andrational, safe and reliable, we should further improve the management system of national foodsafety standards and procedures. What’s more，we also improve national food safety standardssolicit feedback mechanism to ensure a smooth channel feedback。In this paper, by referring to the relevant literature we use the case studies, comparativeanalysis and other methods to have a basic research on some of the legal system of the foodsafety standards。Study includes the meaning of food safety standards, the nature, theclassification, the development, the function and the meaning。Through comparing with thefood safety standards of the EU, the U.S., Japan and other developed countries，we have a good analysis of China’sfood safety standards system status and problems, etc.，so that we can discovere the problemsand learn from international experience, and ultimately improve our food safety standardsproposed system, improve food safety standards to implement and improve the supervisionand management of food safety standards specific countermeasures。...
