With the rapid development of economy, the highway have a rapid development.Our country has about85000kilometers, ranking second in the world. Meanwhilehighway development is also accompanied by a lot of new problems, particularlyevasion problem. The behavior of escaping fee is not provided in criminal law.Mostly the punishment pay tolls, if the circumstances are serious administrativedetention administrative detention. With the huge economic interests, the cost ofillegal evasion behavior is less than punishment.This paper consists of introduction, body and conclusion. First of all, this paperintroduced the current situation of punching the card on freeway and the situationdealing with the behavior in judicial practice. Secondly, it presented the concept,characteristics and manifestations of punching the card. Once again, it concluded thequalitative disputes on the act, assuming the theory of guilty and the theory ofinnocent, then firstly analyzing the theory of innocent, proceeding to propose thatthere are shortcomings with the view, next it introduced the controversial views in thetheory of guilty, in addition,providing my proposals. Ultimately, through proceedingwith the nature of highway toll and the action structure of punching the card, it wouldreach the view of characterization, assuming that the act establishes the snatch crime.Thus, the paper comes to a conclusion, and I would raise some problems requiringfurther discussion, such as, on encountering problem of determining the nature ofspecific crime, how can we make the choice between the view of legislation and theview of interpretation, expecting to conduct further study in the future.
