| xenotransplantation, the transplantation of animal’s organs, tissues or cells intohumans whether genetically modified or not,could be able to cure people of manydisease which in former timers would have killed them.Xenotransplantation maybecome a medical reality in the future, it will begin a new field to save human life.However xenotransplantation also gives us a potential risk, which are immunerejection and cross-species infection.Restricted by the current level of study,we cannot predict all the risks and benefits of xenotransplantation accurately.So the researchof xenotransplantation has been highly controversial.This article is based on theresearch of xenotransplantation has its’feasibility,I focus on the legal issues involvedin xenotransplantation by drawing foreign laws and regulations,such as humanrights,the protection of animals,xenotransplantation research guidelines and relatedlegislative proposals.In the first part, the author introduces the concept and significance ofxenotransplantation,and make thorough inquire on the legal issues involved inxenotransplantation. To explore the xenotransplantation from the perspective of lifeand health, informed consent, the right to human dignity, liberty, privacy andprotection of animals.In the second part,the author elaborates the attitude ofxenotransplantation from different academia parties.The research ofxenotransplantation is controversial for a long time.We have to deal the conflictbetween the individual rights and the public Interests in the exploration process ofxenotransplantation.It is not a solution to prohibit any risk experiment,any humanprogress had to pay.What we really should do is improve the legal.The author deemthat xenotransplantation should be limited cautiously, so that xenotransplantation canbe scientific and rational control.In the third part,firstly the author elaborates theStatus of national legislation xenotransplantation.Secondly, the author uses themethod of contrast to generalize and gets inspiration.In the last part,the authoranalyzes the necessity and feasibility to improve the xenotransplantation legislation.Under the legal framework,the suggestion about setting up program that accords with the canon of medical and life ethics are proposed, which is on the base of the basicprinciple and legislative experience of the research of foreign xenotransplantation,and aim at the problem of our country’s xenotransplantation... |
