The Copyright Protection Of Fashion Design

Clothing design is artistic, it is the achievements of human civilization, and the creatorpays out diligence and wisdom. It should be protected by copyright law. Internationalconvention on copyright protection and the relevant countries or regions have clothing designinto the "work" within the scope of copyright protection，however，copyright law in ourcountry have not clear. The limitations of the current clothing design legal protection lead toclothing "piracy" phenomenon; it becomes a big problem in garment industry. With thedevelopment of garment industry, it needs to study the copyright protection systemconstruction of clothing design. The chapter I first introduces the research background，contents and methods of this article; The chapter II firstly expounds the contents of thecostume design，then states the standard of copyrighted works and the rules for copyrightinfringement of clothing design. It illustrates that the garment design belongs to "work" of thecategory of copyright, and making the clothing design into copyright law is operability;Chapter III introduces the legislative and judicial status quo of dress design copyrightprotection. Then point out specific problems of clothing design copyright protection in ourcountry. It aims at explaining the necessity of copyright protection clothing design; ChapterIV Puts forward our country’s clothing design protection mode on the basis of the legislativeexperience of other countries,and analyzes in detail the reasons and solutions of clothingdesign copyright and patent of appearance design’s competition and conflict; Chapter V is theimprovement of the specific content copyright protection in costume design, includingperfecting the protection of ready-made clothing and clothing structure, perfect the copy rightrules, expand the category of reproduction behavior, implement copyright registrationprotection in clothing design and so on.
