Analysis Of Rural Women’s Land Rights And Interests Under The Background Of Land Right Determination And Registration

In 2010, the central file No.1 in China puts forward the land right determination and registration to protect the land rights and interests of farmers, to speed up the land circulation, so as to adapt to the pace of agricultural modernization. The authority card of land was issued by the family, and it’s the legal evidence to confirm the legal rights of farmer in the collective land and the most important basis to safeguard holder’s legal rights and interests. Land right registration is meaningful for everyone. Our country is in the circumstances of agricultural feminization nowadays, which women have become the main force of agricultural production and rural construction. If women’s name unable reflect on the land ownership certificate and their land rights and interests can’t be protected, not only will seriously affect women’s labor enthusiasm and investment in land, will also affect our country’s food production safety and the whole social harmony and stability. Land right determination and registration aims to protect all farmer’s land rights and interests. As a rural women whose land rights and interests is vulnerable, whether also can get security in this procedure of land right registration? The land approval work for women is a opportunity to gain equal land rights with man, or a repeat of inequality? The author carried out related research with these problems.At present land approval work in our country is still in progress. In order to obtain first-hand data, the author choose the land registration pilot F village to make field investigation.By the participation of land approval process as well as to make depth interview with the members of the village committee and dozens of women,the author reveals the status of women’s land rights and interests in F village is not optimistic:unmarried women are not equal with men on the land initial allocation, female who got married faces the risk of land losses, divorced and widowed women’s land rights and interests will be deprived at any time. The land right registration work not only failed to protect women’s rights to land, on the contrary made the weak position of rural women more obvious. Combined with the process of land right determination registration, from the women themselves, the organizational mechanism, the propaganda, and social environment, the author analyses the reason why women’s land rights and interests is damaged in F village, and put forward suggestions and countermeasures to guarantee women’s land rights and interests.The paper includes six parts. The first part is the introduction. By analyzing the background and significance of the research, the author emphasizes the reality and urgency of the study about women’s land rights and interests,and also the research direction and content. The second part mainly introduces the related concept,the theory tools and research methods and idea. The third part and the fourth part are the results that author got in field research, which are the main content of the article. In the third part, the author introduces the related situation of F village including introduction, land contract and the land right determination and registration work.In the fourth part, the author makes a detailed description for the current status of F village women’s land rights and interests, reveals that women’s land rights and interests is damaged in F village at present, and analyzes the effect of the land right determination and registrationon women’s land rights and interests. This part is the answer to author’s question that due to land approval work only register the information of the head of the household, and many women can’t be registered, so that the state of women’s land rights and interests from the recessive deprivation into a dominant deprivation, and the women who lost land show "cured" state. Land registration can’t protect the land rights and interests of women,even makes the women more dependent on men, strengthened the disadvantaged position of women.The fifth part is the analysis of the causes why women’s land rights and interests is damaged, respectively from the women themselves, the system mechanism, the organizational propaganda and the social environment under the background of land registration. The sixth chapter is the countermeasure and the suggestion to safeguard the rural women’s land rights and interests. By combining region actual situation and referencing successful experience, the author puts forward several countermeasures and the suggestions to safeguard women’s land rights and interests, including improving the awareness of women’s rights, amending unreasonable village regulations, increasing the social gender perspective of law and policy, improving the management ability of the village leader, perfecting the land circulation policy and the remedy mechanism of land rights, doing well on land registration. The last part is the conclusion,summarizing the research results, making reflection on the insufficiency, and pointing out the direction of improvement.
