In recent years,with the prosperity of our economy,further reform of the housing systemand the deepening of the real estate market and adapt to the rapid development and health.Active in the real estate market and accelerate the urbanization process,as well as people’sliving standards improve,people’s increasing demand for housing,real estate sales markettrading is becoming very common behavior. However,sales in the pre-sale market also reflectsa series of problems to be solved. Currently,two types of real estate sales methods thatexisting building sales and real estate sale. In China,on sales of commercial laws andregulations more general most of the relevant legal system is not perfect,especially forpre-sale provisions of the legal system is not perfect,many questions did not make detailedprovisions effectively,did not cause many problems to solve specific legal norms as abasis,not well standardized development of the real estate marke t and protect the interests ofbuyers and sellers. Therefore,this paper aims to study the various legal issues of real estatesale system exists analyzed to find out solutions to further improve our sales of commerciallaws and regulations to promote the real estate market is healthy,orderly and sustainabledevelopment.In this paper,ask questions,analyze problems,to solve the problem of the status oflegislative real estate sale set forth the legal system,pointed out the lack of relevant laws andreal estate sale in solving the problem,based on the detailed analysis of these issues on tostudy how to further improve the legal system of real estate sale,standardize and improve thereal estate market. Research paper is structured as follows:In the preface describes the legalregulation of pre-sale status and significance of the topic,review the status of the legal systemof the pre-sale of domestic and foreign real estate research to clarify the ideas and innovationsof the writing of this article,as discussed below real estate sale foreshadowed the legal system.In this paper,the main part of the first chapter,the basic theory expanded from real estatesale,real estate sales elaborated the concept and sales,as well as differences between the twomethods,especially the legal nature of the real estate sale conducted defined below,for the study of pre-sale system has laid a solid foundation. The second chapter from the perspectiveof the status of domestic legislation,describes the status of the domestic legal system of realestate sale,real estate sales indicate the presence of legal and regulatory mechanisms areinadequate,lack of consumer rights protection system,pre-funding oversight,no legalresponsibility and a series of legal issues clear,pre-sale system needs improvement. The thirdchapter analyzes the legal regulation of foreign real estate sale situation,comparing domesticand foreign legal system,provide a reference for the perfection of the legal system of realestate sale;fourth chapter by strengthening the effective regulation of the real estatemarket,improve the regulatory system pre-funding establish a series of punitive measures tofurther improve the mechanism related to the legal system of real estate sale,real estate salesto gradually improve our legal system,while strengthening its convergence with the relevantlaws and regulations applicable on. In order to regulate China’s real estate market,protect thelegitimate rights and interests of buyers. The conclusion by a summary of the content of t hearticle,indicates that China’s sales of commercial legal regulations,in particular the need towork together with all legal practitioners and scholars to better improve the legal system inthe real estate sale,so as to solve in real estate sales process a series of legal issues that mustbe addressed,to better protect the interests of consumers,and promote the sustainabledevelopment of the real estate market.
