Study On The Policy System Of Improving Patent Quality In The United States And Its Enlightenment To China

The patent protection policy of the United States was written into the constitution at the beginning of the founding of the People's Republic of China,from the concrete construction of the policy system to the continuous adjustment and improvement in the development.The history of more than 200 years has witnessed the economic and social changes of the United States,promoted the sustainable development of the innovation economy of the United States,and provided important reference for the construction of patent policy system of other countries.Under the influence of the "pro-patent" policy in the 1980 s,the number of patents in the United States expanded rapidly,and serious quality problems emerged in the patent field.In order to restrain the flood of "problem patents" and protect the development of innovation economy,the United States has once again started the adjustment and reform of patent policy.Starting from the research on "patent quality" by domestic and foreign scholars in recent years,this paper explains in detail the connotation,evaluation index,influencing factors of patent quality and the policy content composition of improving patent quality.On the basis of in-depth analysis of the specific problems in the field of patent quality in the United States,this paper divides its policy efforts to solve the problems since the end of the last century into three stages,and makes a detailed analysis and explanation.Accordingly,this paper ponders and summarizes the advantages and disadvantages of the content of the policy system to improve patent quality.Finally,based on the above analysis,combined with the national conditions of China,the paper summarizes the enlightenment of the content of the policy system of improving patent quality in the United States to China.
