In recent years, advocacy advertising in our country has developed into craze. Itsdiverse manifestations and new technology is endless. However, a large number offalse advertising also stepped in, filled with our lives. Caused by a false advertisinglawsuit spokesperson also increasing, but such cases are often lost to the consumer inthe end. False advertising spokesperson whether to legal liability? How liable? Hasbecome the focus of increasing concern to the public. However, due to China’s currentlaw is not perfect, resulting in the investigated legal responsibility, the falseadvertising spokesperson legal status and responsibility is not to be ignored, that isdifficult to investigate. Therefore, this paper considers false advertising spokespersonmust bear the corresponding legal responsibility and liability for false spokesmenanalysis, and finally put forward a sound legal responsibility of false advertisingspokesperson recommendations.In addition to the introduction and conclusion of this article is divided into fivechapters on the legal responsibility of false advertising spokesperson for analysis arediscussed. The first chapter is by defining the concepts of false advertisingspokesperson, explained the spokesman of false advertising and definitions, andfalse advertising, classified advertising and manifestations spokesperson elaboratedrespectively. The second chapter describes the different views of the academia.Whether it should be liable for false advertising spokesmen when consumers sufferthis problem, the author mainly discusses the basic principles of civil law and theneed for legal liability from that of false advertising spokesperson must bear legalresponsibility. The third chapter is false advertising spokesperson elaborated legalliability, mainly from the dominant position of the analysis, civil and administrativeliability, criminal liable for false advertising spokesperson. The fourth chapter is acombination of the current status of legislation, law enforcement and consumerprotection, analysis of false advertising spokesperson liability problem. The fifthchapter is mainly through the previous analysis, put forward a sound legal responsibilities of false advertising spokesperson comments and suggestions. Pointedout that in order to protect the legitimate interests of consumers, we need legislation,enforcement and consumer protection are three aspects to improve the legal liabilityof false advertising spokesperson.
