Since ancient times, the right of free migration is a basic humanright, which is an essential, fundamental rights for people’s survival anddevelopment, the pursuit of happiness, the realize the value and goals of life.It is fundamental in the whole constitutional rights system. The presentsociety is a time when rights are highly respected. The right of free migrationis constitutionally or legally recognized and protected by most countriesglobally, but our present constitution does not include this kind of right.Along with the urbanization advancement of our country, the lack of freedomof migration has become an obstacle to the development of urbanization, butit also bindes freedom and development of individual citizens, hinders theeffective allocation of the market for labor and so on, which attracts moreand more attention. Under the background of our country’s urbanization, thispaper elaborates on the establishment and perfection of the freedom ofmigration, especially the largest obstacle——current household registrationsystem.The first mention of "freedom of movement" on the work of NPC and CPPCCon2013report shows that in the process of urbanization of China, thegovernment attaches importance to the right of freedom of migration, and mainlyfocuses on the establishment of the main obstacle to the freedom of migration——the household registration system. The freedom of migration has becomea necessary condition and realistic portrayal for urbanization. Therefore,we should set up the concept of the freedom of migration, starting from theconstitutional and legal protection, reform relative social systems,especially the reform of the household registration system, to betterestablish the right of free migration. The author hopes to provide ideas forthe fundamental right of migrating freedom through the research on aboveproblems, make some contribution to the establishment of the right of freedom of migration.This paper is divided into four chapters; the main contents are as follows:The first chapter mainly analyzes the basic theory of the right to freedomof movement. Starting from the meaning, the characteristic and theessence of the right to freedom of migration, describes thetheoretical, legal and realistic basis, and then describes the historicalevolution of the right of the freedom of migration, in the end, analyzes theurgent need for the urbanization of the right of free migration in ourcountry.The second chapter mainly analyzes the status quo of the right of freedomof migration in our country. This mainly includes three aspects: one is thelack of freedom of migration in our constitution, which mainly refers to thenot having clear protection, and further analysis of the status of flowingpopulation in China; the second aspect is the household registration systemhas become the biggest obstacle to the establishment of the right of freemigration, introduces the specific performance of the household registrationsystem of the right of free migration barriers in detail.The third chapter analyze mainly from foreign theoretical system andpractice of the of freedom of migration. Starting from the theoretical systemof the right of free migration abroad, analyses American, Switzerland, Germanyand other countries constitutional specific provisions on freedom of migration,and gets to know the implementation of the program me of the right of freedomof migration of America and several other countries.The fourth chapter links China’s actual situation, from the establishmentof the right of free migration concept, restore freedom of migration in theconstitution, laws and regulations system and the reform of the social systemand the household registration system and other aspects in detail, and putsforward the basic ideas of freedom of migration in china.
