The Protection And Realization Of Citizen's Freedom Of Migration In China For Postgraduates

The freedom of migration is an inalienable fundamental rights of citizens,a lot of countries in the world have carried on the stipulation,International Convention of the Universal Declaration of human rights and Civil and Political rights also confirmed the right.But China's current constitution does not require citizens the right to freedom of movement at that time,because of historical and economic considerations,but in the construction of socialist rule of law and market economy condition,it is necessary to confirm the constitutional rights of citizens.In order to construct our citizen's right of free migration system,we should interpret the term,three aspects of the legal definition of freedom migration,then introduces the evolution of the freedom migration.The development of the freedom of foreign migration and freedom of migration in our country,the change for us to study the migration freedom of our citizens protection and realization of the right to provide the reference.On this basis and based on reality,we find the obstacles of right to freedom migration on assurance and reality.To the point and surface combined with the actual situation and the latest laws and regulations,we analysis the status in right to freedom migration from the three aspects of household registration,education and social security system.We analysis on the freedom of migration barriers from the three aspects in legislation,idea and institution.The safeguard and the realization of our citizens the right to freedom of movement should be a rational thinking to treat it.The citizen's freedom of migration should be write into the constitution and we should stipulate related measures of remedies.We should take care the related system reform.In order to make the freedom of migration the right for our citizens to be effectively protected and realized,the household registration,education,land and finance system also improve.
