The control of mental patients is not only a legal matter, but also a social problem,which has attracted wide attention. Excessive mental patients are unsupervised andscattering in the society, which is a major risk affecting social stability and harmony.Taking the protection of human rights of mental patients and social defense into account,Compulsory Medical Treatment Procedure is designed to eliminate the dangerousnessof mental patients and to provide mandatory treatment and social assistance to helpthem return to society again. In spite of the rapid development and the significantbreakthrough of the Compulsory Medical Treatment Procedure of China in recent years,there are still several unreasonable designs in the system and imperfect regulations onrights of mental patients, compared with foreign legislation. In general, there is stillspace for the development of the Compulsory Medical Treatment Procedure System ofChina. It is just the reason why we study the Compulsory Medical Treatment ProcedureSystem of China. This paper focuses on studying on the legislative situation in China totake several suggestions in order to improve the Compulsory Medical TreatmentProcedure System of China, and doing a summary finally. The paper is mainly dividedinto five parts:The first part is an overview of Compulsory Medical Treatment Procedure.Analyze the legislative background, the basic meanings and basic principles ofCompulsory Medical Treatment Procedure to have a broad understanding.The second part is about the legislative development and the current legislation ofCompulsory Medical Treatment Procedure in China. Describe the historicaldevelopment and the current legislation of Compulsory Medical Treatment Procedure inChina.The third part is an analysis of defects of Compulsory Medical TreatmentProcedure in China. Analyze the current legislative conflicts of our country andobstacles in the process, and generalize how to improve.The fourth part is a comparative analysis of extraterritorial regulations ofCompulsory Medical Treatment Procedure. Study the relative regulations of the UK,USA, Canada, Russia, Germany and South Korea, summarize their characteristics andanalyze their reference.The fifth part is about the improvement of Compulsory Medical Treatment Procedure System in China. Take several reasonable suggestions to harmonize thelegislative conflicts and to get rid of obstacles in the process. And do a summary at last.
