A Thought On The Behavior Of "Good Samaritans" Through Law

Mutual assistance and honesty are the inevitable requirements for building aharmonious society. As one of the manifestations of social mutual, help amongmembers of righteous is the traditional virtues of the Chinese nation from ancienttimes, and it is advocated in contemporary society by the noble manners. However,with the complexity of economic increase and the enhancement of people legal ideas,heroic acts tend to experience unnecessary trouble even the dispute, heroes blood andtears often occurs, it brings a lots of inconvenience to heroes’ learning, living andworking. The other hand, if heroes’ interests suffered losses, and do not get effectiverelief,it may exacerbate the indifference of the society. This paper starts from theconcept of righteous behavior, through analysis of the legal nature of the heroic,particularly in its comparison with spontaneous agency, exploring legal remedies tothe heroic, and put forward some of views about heroic relief system in order toprotect the righteous better, and building a friendship, unity and harmonious society.
