Antimonopoly law is the basis of market economy law. Research antitrust law and policy is alsoan important issue of China’s socialist market economy. In the United States, European Union, Japanand other countries and regions, antimonopoly law is the most important public policy. For decadesour country has made considerable development in civil aviation and market-oriented reforms aredeeper and deeper. Under the background of the antimonopoly law in China, the civil aviation inChina not only introduce the market mechanism, but also strengthen anti-monopoly regulation andmaintaining fair competition. This article is from research conducted under the antitrust laws toimplement the background. And propose appropriate measures to safeguard effective competitionmechanism of the air transport industry, and promote the health of our civil aviation industry, developfreely.The article first reviews the development process of China’s civil aviation industry and antitruststatus. Next, the article describes the main forms and hazards of the monopoly in civil aviationindustry in China. We discussed the major form of our country civil aviation monopoly and itsfeatures at present. Such as the establishment fare alliance boycotts private enterprises, pass operatingcosts, fuel monopoly aviation materials and so on, and the situation is still serious administrativemonopoly. Then, the article tries to discussing the foreign civil aviation anti-monopoly law systemand experiences. The United States, the European Union and Japan in the airline industry hasaccumulated rich experiences on antitrust issues. These experiences can provide a reference for civilaviation anti-monopoly legislation in China. The article analyzes the current anti-monopolylegislation system of civil aviation and expounds the aspects which need to improve of the system ofantitrust law in China to achieve fair and liberalization of aviation market.
