| With more and more intensive study of antimonopoly law, antimonopoly problem on public utilities as civil aviation enterprises has become the hot spot of society. Since seventies of the last century, competition has been introduced into practice by civil aviation industries around world. But in China affected by original planned economy, few state-owned civil aviation enterprises still stand monopoly position of civil aviation industry in transforming period, which cause a various of abuses. While other industries in China as telecommunications industry are carrying out antimonopoly action, the same problem on civil aviation enterprises shall be also paid close attention on. This article is trying to analyze the problems from the point of law.For a start, the article takes use of a narrow sense concept, which means civil aviation transporting enterprises including ones using air crafts to deal with the business of manufacture and transportation. Next, the article expounds the developing course and current situation of civil aviation enterprises, concludes the current main forms of monopoly conduct of Chinese civil aviation enterprises, and under above all analyses tries to find out the causes of formation from the points of institutional factor, interest motivating factor and industry factor. Then, the article tries to confer with the necessity for carrying out antimonopoly action among civil aviation enterprise and make further analyses from the points of the necessity of enhancing international competitive strength, the requirement of creating a environment of fair competition and obligation of abiding by the rules of WTO, which attached with feasibility analysis on the feasibility of carrying out antimonopoly action among civil aviation enterprises from the points of international trend, domestic experiences, and individual traits of civil aviation industry. Finally, the article dissects current antimonopoly situation of domestic civil aviation enterprises, and makes some recommendations including perfecting relational laws for civil aviation enterprises, setting up antimonopoly institution, and normalizing law enforcement process and law enforcement officials. |
