Standardization of sentencing reform is the major revolution project of China’smajorjudicial reform project in recent years. The core meaning is to solve theproblem of judicial sentencing imbalance and to effectively regulate the discretion ofjudge to make penalty discretion reasonable, fair and transparent. Since2010,thereform of standardization of sentencing has obtained a series of significant stageresults: two instructive files are released; the method of sentencing of “combinationof qualitative and quantitative analyses" is established; the three steps of startingpoint, benchmark sentence, and declared sentence are set; the implementation ofpilot work in the country is instructed. After reform, good social effect and legaleffect are gained: criminal lawsuit efficiency has been improved a lot. Take sentencebreath rate and the criminal supplementary civil action withdrawal rates arehigh;quality of judge is improved a lot. Sentence are more fair and balanced; theauthority of people’s court is continuously improving. People are more satisfied withcriminal trial work.
