On The Improvement Of China’s Criminal Legal Aid System

The criminal legal aid system is incorporated in multiple International Conventions and isregarded as an important part of law system all over the world. The criminal legal aid systemhas become a criterion to judge the level of monocracy in a country or region. With thedevelopment of the legal aid system and law system, the criminal legal aid system of ourcountry has also experienced a long and implicated phrase. With comparative and empiricalanalysis method, the author analyzes the status quo of the legislation and practice of criminallegal aid system. The shortcomings and difficulties of the criminal legal aid system are alsoanalyzed and illustrated. Suggestions to refine the shortcomings and then proposedsubsequently.This thesis consists of three parts in total.In Part1, the author seriously studies the history and outline of the criminal legal aid systemin our country and then tries to illustrate its status quo of the legislation and practice. Thenachievements and defects of the criminal legal aid system are also pointed out.In Part2, the author puts an emphasis on studying the criminal legal aid system in othercountries or regions. The criminal legal aid system in Britain, the United States, theNetherlands, Australia, Japan and Taiwan and studied to illustrate their implications on ourcountries.In Part3, with comprehensive analyses and comparisons, the author puts forward somesuggestions to refine the criminal legal aid system in our country so that it can reach a moreadvanced and mature stage.
