Research On Standardization Of Video Monitoring Evidence Collection In Criminal Investigation

With the progress of science and technology level and the continuous improvement of personal safety needs,high-tech electronic products have been widely used in social management.Thanks to the rapid development and widespread popularization of electronic technology,video surveillance,originally used in commercial security and private applications,has gradually become an effective technical means for investigative organs,and has been widely used in crime surveillance,administrative supervision and criminal investigation.With the increasing of video surveillance equipment in public places,it provides greater convenience for electronic forensics in criminal investigation,but at the same time,the incidents of infringement on personal privacy are also increasing.The role of video surveillance and forensics in criminal proceedings has gradually presented a series of problems,which has also led to the regulation of video surveillance behavior in public places and the protection of personal privacy become a big controversy.The application practice of video surveillance in our country started late,and the relevant laws and regulations are not perfect enough for the extraction of video surveillance evidence,and the system mechanism is lagging behind.Although some local governments have formulated administrative rules and regulations for management,the inconsistency of trial standards has led to the fact that each region has its own way in the actual work,resulting in confusion in management.This paper combines the theory with the practice of public security work,takes the research of video surveillance evidence collection as the leading factor,and systematically explores the problem of video surveillance evidence collection in criminal investigation by means of literature research,investigation and analysis,comparison,induction,summary and discussion.From the legal point of view,this paper analyses the irregularity of forensics and its possible legal consequences.In view of the existing problems,this paper puts forward relevant suggestions on the standardization of video surveillance evidence combined with relevant foreign cases.This article will elaborate the application of video surveillance in criminal proceedings from the following five parts.The first part is the introduction.The second part is an overview of video surveillance evidence,including the concept and development process of video surveillance evidence,the characteristics of video surveillance evidence,the types of video surveillance in public places and the role of video surveillance,and the characteristics and functions of video surveillance as a whole.The third part elaborates the application methods and functions of video surveillance in criminal investigation,and introduces the application methods of video surveillance in identifying the facts of the case,seizing the perpetrators,vehicles and other methods,as well as its extreme importance to criminal investigation.The fourth part firstly analyses the concept of video surveillance evidence collection in criminal investigation,the purpose and function of evidence collection,the traditional norms of evidence collection in the actual process of handling a case,and points out that there are many aspects of video surveillance evidence collection,such as the subject of evidence collection,the procedure of evidence collection,the method of evidence collection,the supervision mechanism of evidence collection and the preservation and use of evidence materials.Real problems and analysis of the causes.The fifth part mainly focuses on human rights protection,case investigation and case trial,and combines with the new criminal procedure law to analyze the consequences caused by the non-standardization of evidence collection,illustrates the seriousness of the actual consequences caused by the non-standardization of evidence collection in video surveillance,and further illustrates the urgency of the research on the standardization of video surveillance evidence collection.In the sixth part,aiming at the current problems in video surveillance evidence collection in China,the author puts forward suggestions on the standardization of video surveillance evidence collection from the aspects of mechanism and implementation in combination with foreign analysis and laws,mainly including the establishment of state organs for the maintenance of public order,the clarification of strict restriction mechanism of video surveillance in public security areas,and the improvement of video surveillance.Technical measures to guarantee evidence collection mechanism,establish and improve the security management mechanism of video data,improve the power supervision mechanism and the legitimacy of evidence collection,relevance,timeliness and primitiveness.By building an all-round,full-process and full-coverage forensics standardization system,we can comprehensively strengthen and standardize the forensics standardization of video surveillance evidence.
