In the recent years, with the development of urbanization, the construction market isin boom. Plenty of different kinds of modern constructions sprout quickly which ledto the rapid development of China’s economy and society. On the other hand, therelevant problems begin to appear. Especially, in recently years, building collapseaccidents occur frequently which poses a great threat to people’s life and property.Such as the collapse of rainbow happened in Jingjiang in Sichuan and the collapse inShanghai and so on. These accidents have already been paid highly attention in thefield of low. The86clause in People’s Republic of China Tort Liability Law whichwas implemented on the July1,2010makes a special regulation on problem that thecollapse of the buildings, constructions and other facilities which hurt people.Above all, this paper will focus on the clause to analysis. Research the legal issuethat the collapse of the building which hurt people and the relevant reparation.Especially focus on the law application which stands out currently. This paper willextend from the following aspects:In chapter1mainly concentrated on the collapse of the constructions which hurtpeople and relevant reparation. What’s more, propose the main research problems inthe paper.In chapter2introduce the legislative system about the collapse of the building whichhurt people and the relevant reparation systematically, hoping to learn some usefulexperience.In chapter3analysis legislative system about the collapse of the building which hurtpeople and relevant reparation in theory, mainly consist of three parts: the elements,responsibility principle and identify the main responsibility.In chapter4analysis the theory and the law application problems for the collapse ofthe buildings, and provide some suggestions.
