| Since80s in20century, the development of IT and the continuous globalization haveenhanced the liquidity and optimization of the capital element. With this background, thedeveloped countries gradually loosen the supervision on the security market while thedeveloping countries open up the domestic security market step by step. The globalization ofthe security market has become an inevitable trend of the global security market development.The globalization of the security market not only promotes the financial development andeconomical prosperity, but also causes the international extension of the financial risk, theasymmetry of the transitional security information as well as the increase of internationalsecurity crime, all of which challenge the security supervision. As a result, how to strengthenthe cooperation in international security supervision, restrict and avoid the negative influencebrought by the security globalization has become a problem faced by all the world. There arethree ways of cooperation in security supervision: bilateral cooperation, regional cooperationand global cooperation. Amongst the three approaches, bilateral cooperation has become themost fundamental and important mode of the international security supervision because of itsflexibility and abundant content. Therefore, the author has chosen the bilateral cooperation inthe international security supervision as the research target of this thesis. Through briefintroductions to three major ways adopted by the countries in the world and comparison to theexperience of American cooperative supervision, this thesis tries to raise concrete advices inorder to perfect Chinese bilateral cooperation taking into account of the Chinese internationalsecurity supervision situation in reality, in order to enhance the bilateral cooperation betweenChina and other countries and guarantee the steady opening up and prosperous developmentof Chinese security market.This thesis contains about35,000words. Except introduction and acknowledgements,there are6parts:Part1briefly introduces the bilateral cooperation of international security marketsupervision. First of all, it introduces the establishment of the globalization of the intentionalsecurity market, the negative influences it brought and the necessary cooperation among thecountries and regions. Secondly, it summaries the necessity and three modes of thecooperation of the international security supervision. At last, the author decided the researchtarget of this thesis, which is the most fundamental and common mode-the bilateral cooperation of international security supervision, and analyzed the goal that the bilateralcooperation needs to reach.Part2dissects the relevant theories of the cooperation in international securitysupervision from the juristic and economic point of view. This fundamental theory alsoapplies to the bilateral cooperation in international security supervision. The theory analysis inthis part is essential to the research of the thesis.Part3,4and5briefly analyse three ways of bilateral cooperation of international securitysupervision worldwide which are bilateral understanding memorandum, judiciary mutualassistance agreement and multi-jurisdiction information disclosure system. Through theanalysis of those problems in its corporation and the practical experiences from thecomparison of American security supervision bilateral corporation, references are providedfor the bilateral corporation of Chinese international security supervision in the last part.Part6makes recommendation on perfecting Chinese international security supervisionbilateral corporation. It firstly illustrates the status quo of Chinese security supervisionbilateral corporation, then analyses the existed problems in China. After that, suggestions aremade in detail for Chinese international security supervision bilateral corporation in fourperspectives i.e. the perfection of corporation rules and regulations, the advance ofcorporation efficiency, the broadening of corporation patterns and the reference of corporationtheoretical experiences. |
