The Present Situation Analysis And The Development Vision Of The Judicial Authentication Institutions In Colleges And Universities In China

The judicial authentication institutions of colleges and universities is not newthings,since the judicial identification of our work has developed, universities havebeen involved in. However，"the Standing Committee of the National People’s Congresson judicial expertise management decision"(hereafter referred to as the "decision")hasnot implemented before2005,our forensic judicial identification business is mainlymonopolied by the three organs(public security, procuratorate and court),the threeorgans can be equipped with the identification in their bodies and its internal staff is themain source of identification.The phenomenon of the self-investigation andself-identification,self-hearing and self-identification had resulted the forensicneutrality of the judicial identification having serious deficiencies,the judicialidentification institutions inside the court were abolished after the implementation of"decision" that marked the official start of the judicial identification system reform,thejudicial authentication institutions of colleges and universities have more space to playin the original basis,the judicial authentication service of colleges and universities alsoobtained the unprecedented development.The establishment of the judicial authentication institutions of colleges anduniversities is the set of high-quality personnel,advanced technology,sophisticatedequipment in a body,the judicial authentication must be appraisal on a ladder standingby these advantages to engage in the business of the judicial authentication.And thejudicial authentication institutions of colleges and universities which can embodymostly the neutrality of judicial identification and public confidence compared withother social judicial authentication institutions and the judicial identification institutionsinside the investigation,that means it will undoubtedly play the main force role in thefuture path of development of judicial identification.However,the judicialauthentication institutions of colleges and universities are lacked of clear thinking fortheir society’s function orientation,its problems and how to solve and improve the lackof clarity of its in the future development currently. Therefore,I consult the related expertise work and academic data of the judicial authentication institutions of collegesand universities,combined with the practice in the judicial authentication center of theUniversity, compared it with the similarities and differences of other social judicialauthentication institutions and the judicial identification institutions inside theinvestigation organs from the view of the characteristics of it, and then start to discussthe judicial authentication institutions of colleges and universities around itsfunction,problems and development vision.This paper is divided into five parts:Part I can be summarized the concept and basic properties.Part II carries on the classification to the judicial authentication institutions inChina and has a detailed analysis to their respective characteristics.According to theanalysis, the most corresponding to the nature of judicial authentication is the judicialauthentication institutions of colleges and universities, its profitability is not strong andits neutrality is best,and it also has a certain authority.Part III mainly has a detailed analysis to the current development of the judicialauthentication institutions of colleges and universities in China.It conducts a detailedcomparison between the judicial authentication institutions of colleges and universitiesand other social judicial authentication institutions and the judicial identificationinstitutions inside the investigation organs,finds the advantages and functions of thejudicial authentication institutions of colleges and universities.Part IV mainly discusses the problems of the judicial authentication institutions ofcolleges and universities in its development process and the development conception inthe future,the emphasis is the judicial authentication institutions of colleges anduniversities which engaged in the business of judicial authentication from theUniversity of judicial authenticators which have part-time identity and then put forwardthe countermeasures to solve the problems.Part V as the conclusion of the article which fulls hope for the development of thejudicial authentication institutions of colleges and universities.
