On Perfection Of The System Of Criminal Judicial Authentication With Chinese Characteristics

In recent years,our country has made many changes in the institution of criminal lawsuit,and the reform is focused on the system of evidenve now.The criminal procedure law of the people’s Republic of China which was implemented in2013has improved the types of evidence and the system of the witness appearing in court.These reform measures provide a good opportunity to the reform of the system of criminal judicial authentication.This thesis takes the system of expert evidence in common law countries as a starting point,and it will dicuss the topic from some aspects as followed.The preface explains the background and significance of the reform of the system of criminal judicial authentication.The first part describes the historical process of the system of expert evidence.This process is divided into six stages and each stage has different characteristics.This part determines the scientific connotation of the system of expert evidence in order to lay the conceptual basis.The second part runs a comparative analysis between the system of expert evidence and the system of criminal judicial authentication.The reasons why the two systems have similarrities and differences are they have different lawsuit idea,litigation structure and evidenve system.This part provides the theoretical basis.The third part researches the current situtations.The development of the system of criminal judicial authentication has met difficulties in the parts of system level,program level and entity level.We must solve these difficulties because they have endangered the fairness and justice of trial.Moreover,the analysis provides direction to the reform.The forth part is the most important part.It is chance with the introduction and integration of the system of expert evidence,we can research the reform approaches in the aspects of management system,program design and entity system.We hope we can establish a new system of criminal judicial authentication with Chinese characteristics through the sensible,reasonable and legal reference and integration.The last part summarizes the main point of the thesis and I hope this thesis can play its part with the reform of the system of criminal judicial authentication.
