| There will be created a huge economic benefits and social benefits by establishing andpopularizing the new housing reverse mortgage system in our country,especiallyimplementing this system in the rural areas,which will significantly help and contribute tosolve the rural pension problems and improve the social security system in rural.But focus onthe actual situation of rural real estate policy or institution,and public acceptance of newconcepts limited by deep-rooted traditional concepts,the implementation of housing reversemortgage system will meet many obstacles,but not unsolvable.This thesis tries to analyze theapplicable obstacles and the necessity of the reverse mortgage system in our rural area,thenbased on the experience of housing reverse mortgage system ai home and abroad put forwardthe countermeasures and suggestions for application in rural.Full-text is divided into five parts to expound.The first part provides an overview of the basic concepts of reverse mortgage system,which compactly analyzes the meaning of the theory and briefly introduces several significantfeatures of reverse mortgage system.Then compare reverse mortgage system with themortgage loans and mortgages, presenting a more exhaustive introduction of this system.Thisparts also discusses the theoretical basis of reverse mortgage system, in addition, it analyzesthe disputes between alienation guarantee-based system, mortgages-based system andpawn-based system, putting forward the issue of this study. The issue is that themortgage-based system is more operational in China because it fits the actual condition andavoid violating certain kinds of laws or rules which cannot be easily changed.The second part states comparison and analysis of the operation condition of reversemortgage system at home and abroad. This part introduced the foreign development of reversemortgage system in several typical countries, the present situation of our urban housingreverse mortgage development,presents homestead circulation in rural and transfer of ruralhousing in several rural pilot areas.After that these existing work experience andenlightenment have been comparative analysed,such as strengthening the propaganda and theguidance and supervision of the government,etc.,in order to lay the foundation for formallyestablishing and promoting the reverse mortgage system in rural.The third part analyse the necessity of application in rural of the new system,mainly analyse on individual development,the social security system,the reform of rural landcirculation and urgent need of economic development in rural areas,by that to demonstrationthat our rural can gradually start to implement system of housing reverse mortgage.The fourth part analyze the obstacle of application the new system in rural.First of all isthat analyze the cultural obstacles which will obstruct the implemention of the new system。The old traditional concept is deeply ingrained that the old rely on children endowment andthat the houses bequest to the offsping.The new concept is so hard to clearly understand forthe old that the acceptance is low.Secondly,the reverse mortgage lenders assume greatrisk,such as the loan may not be able to take back,or the houses lose value,or theunderdevelopment real estate secondary market make the lenders unfavoring get paid bysell-off the houses.If there is no third party to share risks,few financial institutions would liketo develop this kind of loan product.The third point is the vital of this part that discuss thelegal policy barriers of application the new system in rural,mainly about the current ruralsocial security policy,including that the rural land policy,the limited rural usufruct of housesite,the principle of legality of right in rem,as well as the rural residents of low-incomefamilies.The last part puts porward countermeasures for applying reverse mortgage system inrural,including propaganda of new concepts,improve the relevant subsidiary law andregulations,the government’s active guidance and supervision in the operation,and finally putsforward to take examples by local pilot experience to set up a kind of rural real estate propertyright trading platform,by that which can satisfy the operating mechanism of housing reversemortgage system which improve in rural,and help to achieve the target of social fairness. |
