With the gradual participation of the peasants in economic life,courts are confronted with more and more cases of execution of the right to the use of cartilage and its outbuildings,which has come to be cruxes to the courts.At present,there is no specific law and rules concerning the coercive execution of the right to the use of curtilage and its outbuildings.Meanwhile,as a result of the limitations on the transfer of the right to the use of curtilage,the courts usually are negative to the execution of the right to the use of curtilage and its outbuildings,which has caused severe damages to the public credibility of the judiciary.Actually,there is no prohibition on the coercive execution of the right to the use of curtilage and its outbuildings at all.The execution of the right to the use of curtilage should not be denied owing to the limitations on its transfer.Nowadays,the function which the right to the use of curtilage performs in guaranteeing the survival of peasants is decreasing gradually.Therefore,the problem concerning the execution of the right to the use of curtilage and its outbuildings can be solved completely by improving the laws relevant to the execution of the right to the use of curtilage and its outbuildings,establishing the rural housing registration system,innovating the diversified modes of coercive execution of the right to the use of curtilage and its outbuildings,enhancing the coordination of courts and other departments,etc.The study of the coercive execution of the right to the use of curtilage and its outbuildings will contribute to solving sharp contradictions in the grass roots,maintaining social honesty system,andpromoting public credibility of judiciary and the masses' acceptance of judiciary.
