The Study On The Basic Problems Of International Investigation Cooperation

Recent years, with the rapid economic and technological development,international crime situation has become even more severe, a variety of increasinglyrampant crime, especially terrorism, crime, economic crime, serious impact on theorder and management of the entire international community, internationalinvestigation co-presented new challenges. The wide application of the moderntransport developed, the opening of national borders, as well as modern science andtechnology, provides great convenience for criminals to evade justice. Faced withsuch a grim situation, we should strengthen the countries in the world, theInternational Criminal Police Organization and other international exchanges andcooperation of the social forces, to establish long-term and effective cooperationmechanism to pass criminal intelligence and clues to the formation of an international"French Open thoroughly to prevent and combat international crime, transnationalcrime, as well as foreign-related crime.The first part will define the concept of an international investigative cooperation,to distinguish it from the related concepts of international investigative cooperation,international police cooperation and criminal justice assistance, elaborate furtherinternational investigative cooperation intended to determine the internationalinvestigative cooperation range.Chapter II mainly discusses the specific investigation of international cooperationmode and principle. International investigation cooperation specific ways mainlyinclude: crime information communication, recovered crime proceeds, controldelivery, arrest the criminal suspect and so on. And this paper from the internationallaw in the sense of international investigation of the basic principles of cooperationand international cooperation investigation peculiar to the basic principles of the twodirection to the international cooperation on the basis of this investigation.Chapter III analyzes China’s international investigation of the current situation ofcooperation as well as the obstacles and problems, and to draw out the fourth partforeshadowing.Chapter IV is the key part of this paper.It puts forward six proposals on theobstacles faced by the international investigation cooperation of China.Theseproposals have both the macro and microcosmic aspect of promoting internationalcooperation,including promoting the legal system, strengthening the cooperation between different counties, expanding the areas of cooperation;Also has the microaspect, is mainly aimed at strengthening personnel training and technical cooperation,carries out the liaison officer system and so on.
