Talking Word Computer Font, Font And Font Software Copyright Protection

In recent years the computer fonts infringement cases have frequently arisen, causingwidespread concern and discussion among the practical and theoretical circles. Because thelaw of our country dose not clearly define, the perspectives that the separate word, word stockand word stock software of computer’s legal nature, applying to which kind of legal modeand other problems are different, especially among theoretical circles, and thus lead suspect tothe correctness of justice, then lead to misunderstanding of public. Taking Beijing FounderElectronics Co., Ltd. v. Guangzhou Procter&Gamble Co., Ltd. and Beijing Carrefourcommercial Co.,Ltd. fonts infringement as the main line, this paper discusses the problems ofthe separate word, word stock and word stock software of computer’s legal nature, applyingto which kind of legal mode, and so on.In addition to the introduction and conclusion, this paper is divided into four parts.The first part briefly describes the facts of Beijing Founder Electronics Co., Ltd. v.Procter&Gamble (Guangzhou) Co., Ltd. and Beijing Carrefour Commercial Co., Ltd. fontinfringement, the dispute focus on the cases, the first instance verdicts, and the secondinstance verdicts. Pointed out that the focus of controversy in this case is whether the wordzigzag font constitute art works and whether it should be given protection by the copyrightlaws, rather than whether to grant legal protection of computer fonts or font overall.The second part analyzes the problem of the word copyright protection in the computerword stocks. Because the concept is weighty to analysis and judge the legal issues, this partdiscuss the definition of the word, word stock, word stock software and their relationshipfirstly. Secondly, this part discuss the nature of word art works, and pointed out that the wordsof word stock are equipped with originality and "aesthetic sense", so the words of word stockare belong to the works of art. Finally, we discuss whether the protection of the single-wordcopyright law infringe the public domain, this paper point out that that will not infringe onthe public domain, on the contrary protection is conducive to the public domain.The third part analysis the nature of computer word stock, combining with the view ofthe domestic well-known scholars, pointed that the whole work stock is not the compilationwork, or the art work or the computer software work. So it can be regarded as a database andhave access to legal protection. Through analysing the word protect mode, we come to theconclusion that we should enact a special law to protect the character. Also this part discussthe relationship between protect the word stock and the word, in our view, the protection of the word stock will not affect the protection of the separate word, they are both different andrelated.The fourth part briefly analysis the related problem of word software. We regard theword software as a piece of software, and the Property of computer word software works doesnot affect the identification of the nature of word works.The article concludes that the protection word in the word stock accessing to copyrightlaw, for the protection is the font of the word zigzag rather than the meaning of word. It willnot harm the public interest. Word stock should be used as a database and should developspecial legal to protect it. Word stock software is a piece of software, it is the tool toreproduce and use the word. Word, word stock and word stock software are both closelyrelated and clearly different.
