Study On The Problem Of The Copyright Protection Of Computer Word Font

Since the Founder v.Procter&Gamble case,the problem of the copyright protection of computer word font has been debated by scholars.The focus of this issue is whether computer word font should be protected by law,and how to protect it.There is no conclusion to these questions in the academic circles.The court is not consistent with the views of similar cases.The author analyzes the content of the dispute to investigate whether computer word font should be protected by copyright law,and how to protect it.By studying on the problem of the copyright protection of computer word font,we can find the reliable theoretical basis for the legislation.Only perfect laws and regulations can provide a clear legal basis for the judicial trial and put an end to the phenomena that similar cases have different results.The legal protection of computer word font is the protection of the development of font industry,is a legal means to balance the interests of all parties,and is also the need for the development of Chinese character culture.This paper is divided into four parts.The first part,the author defines the concept about the protection of computer font word,and to analyze the concept which easy to be confused.Under the premise of clear concept,the author combs and summarizes the academic circles' views on the legal protection of computer word font.The second part,the author analyzes the legal attribute of the computer word font to demonstrate the focus of debate:the original of computer word font.And by clarifying the relationship between the protection of computer word font and public domain to illustrate the rationality of the copyright protection of computer word font.Then from the computer font industry development,safeguard judicial authority,fill up the blank of law,achieve the balance of interests,encourage cultural creation and promotion of cultural prosperity,the author explains the necessity of the copyright protection of computer word font.The third part is a study of overseas legislation.The author hopes to find out the experience which can be used for reference on the basis of comparative analysis of overseas countries and regional legislation.The fourth part is based on the situation of our country.The author puts forward some points on our copyright protection of computer word font according to the conception of foreign advanced experience.We need to clear the computer word font should be protected by the copyright law,then the author puts forward some suggestions in several aspects,such as determining the originality standard of computer word font,limiting the scope of rights,judging the infringement and so on.
