With the rapid development of economy and the growing population, theso-called "sandwich layer" groups appears,and the important content of guaranteesandwich layer groups’ housing needs is how to ensure people’s basic housing right.In this background, our country starts to explore the development of public rentalhousing. However, on the road of exploring public rental housing, there are manyproblems, and one of the most prominent problem is money.This article analysis and sorts financing system of public rental housing from theperspective of legal,and this article mainly divides into four parts:The first part is the basic theory of public rental housing. This part firstlyintroduces the concept and characteristics of public rental housing.Public rentalhousing points the indemnificatory housing in limited construction standards and therent level, facing urban middle-class income housing difficult family that meetrequirements,new employment without house and migrant workers in cities and towns,having some characteristics such as communal property rights, governmentintervention, the specific subject non-profit and etc.Secondly, introduces the systemvalue of the public rental housing. Sandwich layer groups in our country at presentcan not achieve the most basic safeguard for housing,seriously affecting the socialstability. In this context, our country begins to develop public rental housingvigorously, not only solving the problem of sandwich layer group’s housing difficult,but also overcoming market failure and government failure in the field of real estate,improving housing guarantee system in our country and promoting social justice. Inthe final,analysis the restriction factors existing in the current development of publicrental housing in our country, especially the funding problem,is the main problem.The second part is an overview of the chongqing public rental housing and thefinancing mode.This part firstly expounds the financing status of public rental housingin chongqing, mainly providing allocated land for free by the government, ensuringthe diversification of funding sources, giving full play to its protection as the thirdfinancial and building clear finance reimbursement model.Secondly,expound thetrouble in financing system of chongqing public rental housing.Government input isnot enough, financing channels is limited,fund utility is very low, lack professionalfinance institutions and profit pattern is unknown.Finally,analysis the causes of public rental housing’s financing difficulties, lacking perfected laws and regulations, thevalue orientation problems of rental housing problem, the functions of the governmentthat not changing, imperfected policy-oriented housing finance system and otherimperfected supporting system.The third part is an overview of public rental housing overseas’ financing mode.This part firstly analysis the financing model of public rental housing in Germany,Korea, Singapore, the United States and Hong Kong,and concluds the lessons forfinancing legal system of public rental housing in our country, give full play to thegovernment’s leading role, set up special financing agency, broaden the financingchannels and pay attention to financial innovation. Among broadening the financingchannels, introduces REITs mode, analysis the feasibility of REITs mode in publicrental housing construction in our country and the negative factor in the developmentof REITs in our country.The fourth part is the Suggestions of perfecting our country’s legal system ofpublic rental housing financing. Firstly,clear the principle of governmentresponsibility and the principle of diversification of the financing channels inFinancing legal system in our country. Secondly, perfect the concrete system of ourpublic rental housing’s financing mode,including clearing responsibilities at all levelsof government, perfecting the existing financing model,setting up special financingmanagement agency, formulating special legislation on REITs,improving the entranceand exit mechanism of public rental housing, perfecting the mode of land supply,improving tax policies and regulations.
