Housing is the basic material elements of human existence. Home ownership is thousands of years people diligently strive after the ideal. Since the establishment of the new China, China’s urban housing system has experienced a changing process from the government directly under the control of the welfare housing model to the market-oriented supply mode, indirect government under the control of both supply mode again to housing security and the housing market, the urban housing security system is gradually establish and perfect. However, in recent years, the real estate market housing irrational structure, housing prices rose too fast, the market overheated investment, housing supply and demand imbalance and other issues, the stable development of the real estate market issues become the focus of the society; but also to the housing security and puts forward a new subject system construction. Eighteen big reports of the party point out: to ensure that the 2020 implementation well-off society in the grand goal, including one of the symbols of "housing security system is the basic formation". Public rental housing is a kind of innovation practice in this context, is an important measure to improve people’s livelihood is the responsibility of the government, China speeds up the beneficial exploration to promote the overall development of rural and urban industrialization, urbanization in the process of development. However, the system of public rental housing as a new, cover a wide range of areas, involving complex system design disciplines, the research on it is still stuck in the "on" type level, lack of theory and macro grasp. Especially the low rent housing and public rental housing allowance, on the "new public rental housing management measures" will experience reconstruction. How the people oriented, to the laws and regulations as the criterion, do a good job in the housing security work, related to the overall economic situation. In order to maintain social harmony and stability, accelerate the transformation of economic society, has important and urgent to study the legal system of public rental housing.In addition to the introduction, this article is divided into four parts:Introduction to the Chongqing Liangjiang New Area of public rental housing policy implementation situation as an example, leads to the current situation of the legal system of public rental housing in our country, puts forward the research methods and innovations of the study content.The first part, the general theoretical problem on the research of the public rental housing system. Starting from the relevant theoretical concept, to explore the characteristics of the system of public rental housing, the direction of development, clarify and grasp the system of public rental housing functions and the related theoretical issues.The second part, the present situation of the implementation of research on China’s public rental housing system. Firstly, the history and the related policy on China’s rental housing system are summarized; the combination of case analysis, the problems and defects existing in the operation of China’s existing legal system of public rental housing, from the three aspects of legislation, law enforcement, judicial elaborates on these problems.The third part, through the comparison and reference of foreign public housing system regulation theory, analyzes its in the security object, investment main body, subject of operation, import mechanism, transfer mechanism, safeguard mechanism and so on practice experience, to provide references and suggestions for the construction of the legal system of public rental housing in our country.The fourth part, on the basis of the experience abroad, combining with the characteristic of the present stage of our country economic, social situation, put forward to perfect the legal system of China’s public rental housing advice from two aspects. One is to choose the path of housing legal system put forward the construction of public rental. From the legislative form mainly includes the perfection of the system of public rental housing law and the introduction of the ideas of market promoting and perfecting the legal system of public rental Chinese. Two is the proposed system conception of public rental housing. Mainly includes the establishment of public rental housing construction land management system, financial management system, administration system, distribution management system, supervision system.In the conclusion part, the present stage of our country public rental housing and legal status are summarized, and the development trend of China’s housing security system into the prospect.
