| Land contract and management right is an important usufruct for the land collectionof farmers,clearly defined in Law of the people s republic of China on propertyright.According to the civil law theory, usufruct is independent of the ownership.Inaddition,land contract and management right is an important property right for farmers,playing employment and social security and other important roles. Thus, in the collectiveland expropriation, land contract and management rights shall obtain compensationindependent of land ownership, this independence should be reflected from themarket-oriented compensation standards and diversified way of compensation. |
